General Terms and Conditions of Sale

2. Purpose of these Terms and Conditions These General Terms and Conditions of Sale (GTCS) define the rights and obligations of the buyer and the seller in the context of the online sale of original artworks (paintings, drawings, animations) offered by Valérie Lacalmontie on the website www.valerielacalmontie.com. Any order placed implies full and unreserved acceptance of these Terms and Conditions.

3. Products The artworks offered for sale are original, unique creations, entirely handmade by the artist. Each artwork is accompanied by a signed certificate of authenticity. The photographs presented on the website aim to reproduce the colors and details of the artworks as accurately as possible but may vary slightly depending on screen displays.

4. Prices Prices are stated in euros (€), inclusive of all taxes (VAT not applicable – article 293B of the French General Tax Code / CGI). The displayed prices do not include potential delivery costs outside metropolitan France. The artist reserves the right to modify prices at any time, but artworks will be invoiced based on the rates in effect at the time the order is placed.

5. Order and Validation The order is confirmed as soon as payment is validated. A confirmation email will be sent to the buyer. The artist reserves the right to refuse any order from a buyer with whom there is a prior dispute.

6. Terms of Payment Payment is made online via the secure payment solution SumUp (banking data is encrypted and not stored). Installment payment options can be considered upon prior request. The order will only be dispatched once full payment has been cleared.

7. Delivery Free shipping within metropolitan France. For international shipping, delivery costs and potential customs duties are the sole responsibility of the buyer. The average delivery timeframe is 7 to 15 working days following the validation of the order. Artworks are carefully packaged and shipped with insurance. The artist cannot be held responsible for delivery delays caused by the carrier or in cases of force majeure. Please note: Upon delivery, the buyer is required to check the condition of the parcel in the presence of the carrier. In the event of any damage caused during transit, the buyer must formulate immediate written reservations with the carrier and notify the artist within 48 hours of receipt. This enables the artist to activate the transport insurance.

8. Right of Withdrawal – Returns and Refunds In accordance with Article L.121-21 of the French Consumer Code, the buyer has a period of 14 days from the receipt of the artwork to exercise their right of withdrawal, without having to provide any justification or pay any penalties.

Return shipping costs are the sole responsibility of the buyer, except in the event of an error attributable to the seller. The refund will be issued within 14 days following the notification of withdrawal, using the same payment method as the one used for the purchase. Returned artworks must be in their original condition, properly protected and packaged. Personalized artworks or those created upon specific custom order by the buyer are not eligible for the right of withdrawal. Artworks returned damaged or soiled by the buyer will neither be accepted nor refunded.

9. Legal Guarantee In accordance with Articles L.217-4 et seq. of the French Consumer Code, the buyer benefits from the legal guarantee of conformity and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

10. Authenticity Each artwork sold is unique and accompanied by a certificate of authenticity signed by the artist.

11. Intellectual Property All artworks, images, and texts present on the website www.valerielacalmontie.com are protected by copyright law (Articles L.111-1 et seq. of the French Intellectual Property Code). No reproduction, distribution, or use is authorized without the prior written permission of the artist.

12. Personal Data Data collected during orders is used solely for processing and tracking sales. Under no circumstances will this data be transferred to third parties. In accordance with the GDPR, the buyer retains a right of access, rectification, and erasure of their personal data, available upon simple request to valerie.lacalmontie@wanadoo.fr.

13. Force Majeure The seller cannot be held liable for any failure to perform duties due to a case of force majeure (natural disaster, pandemic, carrier strikes, etc.).

14. Governing Law and Disputes These Terms and Conditions are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. Failing that, the French courts shall have exclusive jurisdiction.
